This website is operated by Guzzardi Art. Throughout the site, the terms “we”, “us” and “our” refer to Guzzardi Art. This website, including all information, tools and services available from this site to you, the user, are conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), These Terms of Service apply to all users of the site, including without limitation to users who are browsers, vendors, customers, merchants, and/ or contributors of content.
By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
COMMERCIAL USE, OWNERSHIP AND RIGHTS.
Ownership of Artwork. I, Guzzardi Art, the artist, solely has copyright and ownership of all images and artworks. Note that the purchase of a print or commission of any custom artwork does not grant ownership or rights to the buyer over any image or Artwork. The Artist is, and will remain, the sole and exclusive owner of all right, title, and interest, throughout the world, to all Artwork and any copies of the Artwork. Solely the artist has the right to use the image, produced under commission circumstances or otherwise for print, commercial purposes, promotion, to make profit off and to resell.
For Commercial use the artist must be contacted to form an agreement and contract. Separate arrangements must be made and confirmed with a signed contract. Including but not limited to the situation that I would give consent to use the artwork in a commercial setting, or sell ownership of the image for a fee.
PERSONAL USE
With written permission only, it is permitted to use my images for personal situations such as your avatar, profile picture, or icon, but only if there is a clear way to directly credit me as the artist and owner of the work. Please credit the image with “Art by Guzzardi Art guzzardiart.com” in the caption/description. Where my url is written it must be linked to clickthrough where applicable. If on social media my account must be @, tagged or linked. If there is no way to credit me for the image then you do not have permission to use the image.
RESTRICTIONS ON USE
It is strictly prohibited to engage in the following activities:
- No printing of images, scanning of print, reprinting, copying or otherwise reproducing the artwork in any other forms, sizes or media without prior written permission of the artist and agreed upon terms.
- No Alterations. Changing, editing, manipulating or otherwise altering the Artwork in any way for any purpose without the prior written permission of Artist. This includes incorporating or combining with other media to produce any other piece of imagery containing elements of the original work. No Use in any trademark, logo, design, or other mark.
- No Unlawful Use, you may not use our images or products for any illegal, unauthorized or immoral purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
- No Products for Resale. The buyer cannot not use the Artwork in any goods or products where the Artwork are the primary value. The buyer cannot sell their print or the artwork in any form for profit or any form of gain.
PRODUCTS OR SERVICES
Descriptions and details of products have had efforts made to be shown accurately, though should be interpreted as approximations, allowing for slight size differentiation, variation in the design’s composition and cropping to adapt to measurements/ratio of print, as well as slight color differentiation to monitor display. We cannot guarantee that your monitor's display of any color will be accurate to the product. We are not responsible for such differences.
Certain products or services may be available exclusively online through the Website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected. While we endeavor to correct any errors on our part such as faulty prints, receival of incorrect or missing prints, we are not obligated to and will judge on a case-by-case basis, working closely with you.
ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
ONLINE STORE TERMS AND GENERAL CONDITIONS
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly provide any information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions, fulfill your order and contact you if needed.
